Terms of Service

Please read these Terms of Service ("Terms") carefully before using PredictQ ("Platform," "we," "us," or "our") at predictq.market. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and PredictQ, Inc., a Delaware corporation. Your use of the Platform, including any content, features, or services offered, constitutes acceptance of these Terms in full. We reserve the right to modify these Terms at any time. Continued use of the Platform following any modification constitutes your acceptance of the revised Terms.

2. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be a resident of any jurisdiction where access to or use of the Platform is prohibited or restricted by law
• Not be listed on any U.S. government list of prohibited or restricted parties

By using the Platform, you represent and warrant that you meet all eligibility requirements. If you do not meet these requirements, you must not access or use the Platform.

3. Restricted Jurisdictions

Prediction markets and related financial activities are subject to varying laws across jurisdictions. You are solely responsible for ensuring your use of the Platform complies with all applicable laws in your jurisdiction.

The Platform may not be available or may be restricted in certain U.S. states and international jurisdictions. We reserve the right to restrict access to users from any jurisdiction at any time without notice. By using the Platform, you represent that your access and use is lawful in your jurisdiction.

We make no representation that the Platform is appropriate or available for use in any particular location. Those who access the Platform from outside authorized jurisdictions do so at their own risk and are responsible for compliance with local laws.

4. Risk Disclosure

IMPORTANT — PLEASE READ CAREFULLY

Prediction markets involve financial risk. You may lose some or all funds you commit to any prediction or market position. Past performance of any trader, analyst, or market is not indicative of future results.

By using the Platform, you acknowledge and agree that:

• Prediction market activity involves inherent financial risk and is speculative in nature
• You are solely responsible for any decisions you make based on content, analysis, leaderboards, trader profiles, or other information provided on the Platform
• PredictQ does not provide investment advice, financial advice, legal advice, or any other professional advice
• No content on the Platform should be construed as a recommendation to buy, sell, or hold any position in any prediction market
• You have sufficient knowledge and experience to evaluate the risks of prediction market activity
• You are not relying on PredictQ for investment or financial decisions

IF YOU DO NOT UNDERSTAND OR ACCEPT THESE RISKS, DO NOT USE THE PLATFORM.

Promotional offers referenced on the Platform are available only to individuals who satisfy all applicable eligibility requirements established by the relevant third-party operator, including minimum age requirements, identity verification procedures, geo-location requirements, and jurisdictional restrictions. Market availability and promotional offers vary by operator and may change without notice.

5. Platform Description

PredictQ is an analytics, content, and community platform for prediction market participants. The Platform provides:

• Expert trader rankings, leaderboards, and performance analytics
• Prediction market data, odds information, and market analysis
• Creator-generated content, picks, and commentary from registered expert traders
• Community features including discussion forums and social tools
• Educational content related to prediction markets

PredictQ does not operate prediction markets, accept wagers, hold user funds, or facilitate financial transactions between users. Any actual prediction market activity occurs on third-party platforms and is subject to those platforms' terms and conditions.

6. User Accounts

6.1 Account Registration

You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

6.2 Account Security

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. PredictQ is not liable for any loss arising from your failure to protect your account credentials.

6.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Platform ceases immediately.

7. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable law, regulation, or third-party rights
• Engage in or facilitate market manipulation, collusion, or fraudulent activity on any prediction market
• Post false, misleading, or deceptive content, including false performance claims
• Impersonate any person or entity or misrepresent your affiliation
• Harass, threaten, or harm other users
• Scrape, crawl, or systematically extract data from the Platform without authorization
• Attempt to gain unauthorized access to any portion of the Platform or its systems
• Introduce malware, viruses, or other harmful code
• Use automated bots or scripts to interact with the Platform without prior written consent
• Reproduce, sell, or commercially exploit any portion of the Platform without authorization

8. Creator Program

Certain users may apply to participate in the PredictQ Creator Program as expert traders or analysts ("Creators"). Participation in the Creator Program is subject to separate Creator Agreement terms, which will be provided upon acceptance into the program.

Creators are independent contributors and are not employees, agents, or partners of PredictQ. Creator content represents the views and opinions of the Creator only and does not constitute advice or endorsement by PredictQ.

PredictQ reserves the right to modify, suspend, or terminate the Creator Program at any time and to remove any Creator content that violates these Terms or our content policies.

9. Intellectual Property

The Platform and its content, including but not limited to text, graphics, logos, software, and data compilations, are owned by or licensed to PredictQ and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes. This license does not include the right to reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any Platform content.

By submitting content to the Platform (including picks, analysis, comments, or other user-generated content), you grant PredictQ a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, modify, and distribute such content in connection with the Platform.

10. Third-Party Services and Links

The Platform may contain links to or integrations with third-party platforms, including prediction market exchanges. These links are provided for convenience only. PredictQ does not endorse, control, or assume responsibility for any third-party content, products, or services. Your use of third-party services is governed by those services' terms and conditions.

10.1 Affiliate Relationships

PredictQ may participate in affiliate, referral, advertising, sponsorship, or revenue-sharing programs with certain third-party operators, exchanges, and service providers. As a result, PredictQ may receive compensation when users click certain links, create accounts, redeem promotional offers, or engage in qualifying activities through those third-party services.

Such compensation does not influence our editorial content, rankings, reviews, analysis, or opinions. We strive to present information fairly and independently; however, promotional offers, incentives, and eligibility requirements are determined solely by the applicable third-party operator and may change at any time without notice. Users should always review the current terms and conditions directly on the operator's website before participating.

11. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PREDICTQ DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PREDICTQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PREDICTQ'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT PAID BY YOU TO PREDICTQ IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless PredictQ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Platform, violation of these Terms, or violation of any third-party rights.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a formal claim, you agree to contact us at support@predictq.market to attempt to resolve the dispute informally for at least 30 days.

14.2 Arbitration

Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Pinellas County, Florida. The arbitrator's decision shall be final and binding.

14.3 Class Action Waiver

You waive any right to participate in a class action lawsuit or class-wide arbitration against PredictQ.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Subject to the arbitration clause above, you consent to personal jurisdiction in the state and federal courts located in Delaware.

16. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and any applicable Creator Agreement, constitute the entire agreement between you and PredictQ.
• Severability: If any provision of these Terms is found invalid, the remaining provisions continue in full force.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
